Welcome to Terra Digital! Our website address is https://www.terradigital.co.za. We are a digital services provider dedicated to delivering quality projects and services to our clients.

Initiating a project

To initiate a project with Terra Digital a 50% non-refundable deposit, based on the discussed quote, is required. This deposit is essential to secure your project with us and ensure our financial security. The project will commence only after the deposit has been cleared.

The remaining 50% of the payment will be due upon the completion of the project.

On our request, we offer the client two complimentary rounds of changes prior to completion. Once the client has provided their second round of feedback, any further alterations or additional requests made after the initial agreement will be subject to an additional cost. This cost will be determined based on the estimated time required to implement these changes and ensure the project meets the client’s specific requirements.

Agreement sign-off

It is essential for the client to carefully review and sign off on a formal agreement. This agreement serves as a mutual understanding between the client and Terra Digital, outlining the project scope, deliverables, timelines, and terms and conditions. By signing the agreement, the client acknowledges their commitment to the project and confirms their understanding of the project details. It is crucial for the client to thoroughly read and understand the agreement, asking any necessary questions or seeking clarifications before providing their signature. The sign-off ensures that both parties are aligned and provides a solid foundation for a successful collaboration.

The client’s responsibilities

We kindly request that our clients avoid any delays during the project process. Upon receiving our quote, there will be a 30-day acceptance period for the deposit. If this 30-day period elapses, the original quote will expire and a new one must be requested.

Terra Digital will not retain materials for unresponsive clients beyond a period of 6 months or longer. We cannot be held responsible for any delays caused by the client. The client forfeits their deposit if they remain unresponsive for a period of 6 months or longer.

Client approval and feedback

It is the client’s responsibility to carefully review and approve all project deliverables, including design drafts, prototypes, or content, within a reasonable time frame. We emphasise the crucial role of timely feedback in ensuring the successful progression of the project. Delays in providing feedback may adversely affect project timelines and the overall completion date. We encourage our clients to prioritise prompt and thorough communication to maintain project momentum and achieve the desired outcomes efficiently.

Termination of services

In the event that either party needs to terminate the project or services, it is important to have clear guidelines in place. The conditions for termination and the procedures involved will be outlined to ensure a smooth process. Should such a situation arise, we encourage open communication and a collaborative approach to resolve any issues prior to considering termination. Any applicable refund policies or fees associated with early termination will be clearly stated in the agreement to provide transparency and clarity for both parties. Our aim is to handle terminations professionally and fairly, while striving to reach a mutually satisfactory resolution.

Our rights

Terra Digital maintains full ownership rights to all materials created throughout the project, including but not limited to designs, prototypes, content, and any other intellectual property developed during the collaboration. These ownership rights will be transferred to the client upon the receipt and approval of the final payment by Terra Digital.

It is important to note that until the final payment has been made and approved, the client does not hold any ownership rights or claim over any aspect of the project. Terra Digital reserves the right to use, display, or modify the project materials until the transfer of ownership takes place. This policy ensures that both parties are protected and that Terra Digital’s creative work is duly compensated before the client assumes complete ownership and control of the project.

Liability and limitations

Terra Digital operates under the principle of delivering high-quality services and products; however, we want to clarify certain limitations of liability. We cannot be held responsible for any damages, losses, or liabilities that may arise from the client’s use or misuse of the project deliverables, including but not limited to websites, software, or other digital assets. The client assumes full responsibility for their use and implementation.

While we strive for accuracy and reliability, we do not warrant that the project deliverables will be error-free. It is the client’s responsibility to thoroughly review and test the deliverables to ensure they align with their expectations. Once the project has been completed, the client takes full responsibility for the project and Terra Digital is not held liable.

In any event, Terra Digital’s liability is limited to the fees paid by the client for the specific project or service rendered. We shall not be held liable for any indirect, consequential, or incidental damages incurred by the client.

Privacy policy

At Terra Digital, we value your privacy and are committed to protecting your personal information. We will never share your personal information with anyone unless instructed to do so by you, the client. All personal information, including but not limited to name, surname, contact details, login information, banking details, location, images, designs, website copy, and any other information specified by the client, will be treated as private and confidential. We do not share this information with any external parties outside of Terra Digital.
